This policy explains how namuh Performance Consulting handles personal information through our website, digital store and enquiries.

In this Policy, “namuh”, “we”, “us” and “our” refer to namuh Performance Consulting, operated by Matthew Stevens, ABN: 48 783 005 009.

1. Information we collect

Depending on how you interact with us, we may collect:

  • your name, email address, telephone number and other contact details;

  • billing information and transaction details;

  • products, programs or services you purchase or request;

  • information included in enquiries, forms, emails or support requests;

  • marketing preferences and subscription choices;

  • information about your training goals, experience and equipment access;

  • health and fitness information provided for coaching, programming or fitness testing;

  • exercise history, training results, progress information and coaching notes;

  • photographs, videos or movement recordings you voluntarily provide;

  • information relating to a parent or guardian where a participant is under 18; and

  • technical information such as IP address, browser, device, website activity and cookie data.

Health and fitness information may include injuries, physical limitations, medical conditions, medications, exercise capacity, testing results and other information relevant to safe participation. We collect this information only where it is reasonably necessary to provide the requested service and with the appropriate consent.

You are not required to provide personal information unless it is necessary to complete a purchase, deliver a requested resource or safely provide a service. However, we may be unable to provide some products or services without the necessary information.

2. How we collect information

We generally collect personal information directly from you when you:

  • purchase a product or service;

  • request a free resource;

  • complete a contact, enquiry or health-screening form;

  • subscribe to marketing communications;

  • communicate with us by email;

  • participate in coaching or fitness testing;

  • create or use a Trainerize account;

  • provide training results, feedback or progress information; or

  • otherwise interact with our website or services.

Our website and service providers may automatically collect technical information through cookies, analytics tools and similar technologies.

3. Why we collect and use information

We use personal information to:

  • process purchases and deliver digital products;

  • provide free resources you request;

  • respond to enquiries and provide customer support;

  • assess the suitability of coaching, programming or fitness-testing services;

  • deliver and adjust training programs;

  • monitor progress and communicate with coaching clients;

  • administer accounts and maintain business records;

  • improve our website, products and services;

  • protect our website and transactions from misuse or fraud;

  • send marketing communications where consent has been provided; and

  • meet legal, insurance, taxation and recordkeeping obligations.

We do not use health or fitness information for unrelated marketing purposes.

4. Service providers

We use reputable third-party providers to operate our business. These may include:

  • Squarespace for website hosting, online-store functions, forms and website analytics;

  • Stripe or another payment provider available through Squarespace for payment processing;

  • Google Workspace for business email, communications and document storage;

  • Trainerize, operated by ABC Fitness, for coaching, training delivery, client communication and progress tracking;

  • Mailchimp, if activated, for managing consenting marketing subscribers and sending email campaigns; and

  • YouTube and other embedded-content providers where videos or external content are displayed.

These providers process information under their own privacy terms and contractual obligations.

Trainerize processes client information on our behalf. namuh determines what client information is collected through the platform and remains responsible for how that information is used and for responding to client privacy requests.

If Mailchimp is used, only contact details, subscription status, interests and appropriate marketing information will be transferred to it. We do not place health-screening information, medical information, injuries, medications, fitness-testing records or detailed coaching notes into Mailchimp.

5. Payments

Payments are processed through third-party payment providers made available through Squarespace, including Stripe.

We may receive your name, email address, billing information, order details, transaction status and limited payment information. We do not directly receive or store your complete payment-card number or security code.

Payment providers process payment and fraud-prevention information under their own privacy policies.

6. Disclosure of information

We disclose personal information only where reasonably necessary to:

  • provide a product or service you have requested;

  • operate our website, store, email, coaching or payment systems;

  • obtain professional advice from insurers, accountants, lawyers or other advisers;

  • protect the safety, rights or property of namuh, our clients or another person;

  • respond to a suspected security incident or unlawful activity; or

  • comply with a lawful request or legal obligation.

We do not sell or rent personal information or customer contact lists.

7. Overseas processing

Some of our service providers and their subcontractors operate or store information outside Australia. Information may be processed in countries including the United States, Canada, India, countries within Europe and other locations in which these providers operate.

Our website uses cookies and similar technologies to:

  • maintain website security;

  • understand website traffic and performance; and

  • support embedded content.

You can manage cookies through the available website controls and your browser settings. Disabling essential cookies may affect website or checkout functionality.

Embedded YouTube videos and other external content may allow the relevant provider to collect technical or usage information under its own privacy policy.

9. Marketing communications

Marketing emails are optional and are sent only where you have subscribed or otherwise provided appropriate consent.

You can unsubscribe at any time by using the unsubscribe link in an email or contacting us.

Order confirmations, product-download emails, service communications and responses to enquiries are transactional communications and are separate from marketing subscriptions.

10. Children and young people

A person under 18 should use our coaching or fitness services with the knowledge and permission of their parent or legal guardian.

Where appropriate, we may collect a parent or guardian’s name, contact details and consent. We may communicate with the parent or guardian about the young person’s participation, safety, program or personal information.

Parents and guardians may contact us to request access to or correction of information relating to a participant under 18, subject to applicable privacy requirements and the circumstances of the request.

11. Storage and security

Personal information may be stored within Squarespace, Google Workspace, Trainerize, our payment provider, our email-marketing provider and other properly authorised business systems.

We take reasonable administrative and technical measures to protect information against loss, misuse, interference, unauthorised access, alteration or disclosure. These measures include controlled account access, secure passwords, multi-factor authentication where available and the security safeguards provided by our technology providers.

No electronic transmission or storage system can be guaranteed to be completely secure.

12. Retention and deletion

We retain personal information only for as long as it is reasonably required to:

  • provide products or services;

  • maintain necessary business and transaction records;

  • manage an active coaching relationship;

  • respond to disputes, complaints or insurance matters; and

  • comply with legal, taxation and recordkeeping obligations.

When information is no longer reasonably required, we take reasonable steps to delete or de-identify it, subject to technical limitations, backup processes and lawful retention requirements.

13. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.

You may also request deletion of information. We will consider deletion requests subject to legal recordkeeping requirements, contractual obligations, safety considerations and legitimate business needs.

We may need to verify your identity before completing a request. We aim to respond within 30 days.

If you believe we have mishandled your personal information, please contact us with details of your concern.

We will acknowledge the complaint, investigate it and aim to provide a response within 30 days.
